Text message terms

These terms cover text messages sent by Eva Shammah Real Estate, a licensed real estate brokerage in Brooklyn, New York. Where you see “we” below, it means Eva Shammah Real Estate.

There are two kinds of message, and you agree to them separately.

Operational messages are about work you have asked us to do: your property search, arranging and confirming showings, offers, the progress of a transaction, and services you have requested.

Marketing messages are recurring promotional texts about listings and real-estate services, sent using automated technology — up to 4 a month. These are optional. Agreeing to marketing messages is not a condition of purchasing any property, goods, or services. You can take our operational messages and not our marketing ones, and we will never treat the two as the same agreement.

Operational messages: frequency varies. They depend on what is happening with your search or transaction — some weeks there will be several, some weeks none.

Marketing messages: up to 4 a month. That is a limit we enforce, not an estimate — our system refuses to send a promotional text to a number that has already had 4 in the last thirty days.

Message and data rates may apply. We do not charge for these messages; your mobile carrier may, according to your plan.

Reply STOP to any message and we will stop texting you immediately — all categories, not just the one you replied to. You will get one final message confirming it. STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT do the same thing.

You can also turn each category off separately, without stopping the other, on your message preferences page.

Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed, so we do not use text messages for anything time-critical without also reaching you another way.

We do not share your mobile phone number, your SMS opt-in, or your consent with third parties or affiliates for their marketing or promotional purposes. The full Privacy Policy says what we do with it.

These are the words shown beside each box on the opt-in page. We keep a copy of them with your consent, so what you agreed to is a matter of record rather than of memory.
