Mobile numbers and text-message consent
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

What we collect
What you give us in the course of buying, selling or renting: your name, phone number, email address, what you are looking for and what you can spend, the properties you have seen, and the paperwork a transaction requires. If you agree to receive text messages we also record that agreement — the date and time, the exact wording you agreed to, how you gave it, and the address and browser you gave it from — because we have to be able to prove we had your permission.
What we do with it
We use it to do the work you have asked us to do: find you properties, arrange showings, put offers together, and keep a transaction moving. If you have agreed to marketing messages, we use your number to tell you about listings and services as well.
Who we share it with
Only where the work requires it, and only what that work requires: the other side’s broker in a transaction, an attorney, a lender or a landlord you have asked us to deal with, and the services we use to run the brokerage (for example our messaging provider, which needs your number to deliver a message you asked for).
We never sell your information, and we never share your mobile number, your SMS opt-in, or your consent with third parties or affiliates for their own marketing or promotional purposes.
Text messages
Operational and marketing text messages are agreed to separately, and neither implies the other. You can stop all of them at any time by replying STOP, or turn either category off on your message preferences page. The SMS Terms set out the programme in full.
How long we keep it
Transaction records are kept as long as New York State requires of a licensed brokerage. Consent and opt-out records are kept permanently and are never edited: they are the evidence that we had permission, and evidence that can be changed is not evidence. Asking us to delete your information does not delete the record that you asked us to stop texting you — that record is what keeps us from texting you again.
Your choices
You can ask us what we hold about you, ask us to correct it, ask us to stop contacting you, or ask us to delete what we are not required to keep. Write to office@esrealtyny.com.
